Warpsplinter not herb-able (?)

I have max herbalisim and when i try to herb the last boss of botanica (warpsplinter) it says that you can not skin him (due to not having high enough skinning) even though it clearly says when you hoover mouse over that you can herb him

included is a screen shot

this only occured after the latest patch as i had done it previous to that without a problem

also i have no mods at all
